淺論中國物流服務業加入WTO後對台商之契機

　中國在加入WTO後，由於服務業市場進一步的開放，使得其整體物流服務業的開放亦日漸擴大，許多國際物流企業紛紛看好中國的內需市場，進而成立中外合資或外商獨資的物流公司，並迅速向各地佈點。中國目前物流服務產業呈現積極發展的狀態，並且在未來也勢必將持續性地成長，故在中國政府頒佈相關物流政策促進物流發展，與外資競相進入中國市場之下，台商應及早整合資金、人才、技術，及資訊化等相關物流資源，做好萬全準備，配合兩岸投資鬆綁政策，以在適當時機下進軍中國物流市場，與國際物流企業進行良性競爭，才能一同分享甜美之果實。

境內支持　Domestic Support
為杜哈回合農業談判三大支柱議題之一，係指以貨幣為單位，來表示各國在其境內所給予某一特定或非特定農產品或農民的補貼。依WTO的分類，所有的境內補貼依其危害貿易公平與影響市場價格的程度，以箱子（boxes，中文譯為措施）區分為琥珀色措施、藍色措施、綠色措施、微量措施以及特殊與差別待遇。

不同於非農產品，烏拉圭農業協定並未全面禁止各國實施農業補貼，惟實施補貼的國家必須於減讓表上承諾每年實施補貼的最高約束水準。目前WTO會員每年農業境內總支持（AMS）約束水準高達140.4億美元，且89.1%來自已開發國家的補貼，造成貿易不公與市場扭曲現象，並嚴重影響開發中國家與低度開發國家的權益，故本議題之重點即在於實質削減境內總補貼。

W/120-classification
於烏拉圭回合談判時，WTO會員參考聯合國中央產品分類表（CPC）有關服務貿易項目，經調整後作成服務貿易談判的服務業分類參考標準（MTN.GNS/W/120，10 July 1991）該文件將服務部門分為商業、通訊、營造及相關工程、配銷、教育、環境、金融、健康及社會、觀光旅遊、休閒文化及運動、運輸、其他等十二個部門，並再細分為155個服務次部門活動，供各會員填寫服務業承諾表之參考。W/120分類標準並不具強制拘束力，會員仍得以其本身分類方法作為承諾基礎。

This book reviews India’s liberalisation measures in the last decade, in cognisance of the impact of the country’s World Trade Organisation (WTO) membership on the same. The collection of articles by subject experts recognises that the changes mandated by WTO membership are but one of the three-pronged liberalisation measures that the country has been subjected to—in the external, domestic (industrial policies) and financial sectors. 摘要： This article aims at analysing the merits and limits of ‘cross-retaliation’ as a mechanism to induce compliance in WTO dispute settlement, specifically from the perspective of developing countries. The focus is on cross-agreement retaliation, in particular with respect to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), as this seems to be the most ‘promising’ area for developing countries. Although there are several legal, economic, and administrative difficulties related to the implementation of a suspension of TRIPS obligations and there is so far no practical experience, this seems to remain an interesting option for developing countries – or at least for the largest ones among them – wishing to obtain greater leverage in the system.
