Ad hoc consultations and resolution of trade concerns

Note by the Secretariat


introduction
Among the issues raised in the Second Review of the Operation and Implementation of the SPS Agreement was the use of ad hoc consultations, as well as of specific trade concerns. This paper summarizes the main proposals that have been made in this regard in the context of the Second Review, and provides some background information regarding the manner in which these issues have been addressed to date.
Article 12.2 of the SPS Agreement provides that:
The Committee shall encourage and facilitate ad hoc consultations or negotiations among Members on specific sanitary or phytosanitary issues. The Committee shall encourage the use of international standards, guidelines or recommendations by all Members and, in this regard, shall sponsor technical consultation

Adoption of the Agenda

The agenda is contained in WTO/AIR/3204 issued on 9 June 2008. Delegations are invited to indicate any items they may wish to raise under "Other Business" (Item 6).

Election of Chairperson

The Committee will elect the new Chairperson, Ms. Xueyan GUO (China).

(2) Implementation of the Agreement

(a) Information from Members - Members are invited to provide any relevant information with regard to their implementation of the Agreement, including with respect to the implementation of the provisions related to risk assessment.
(b) Specific trade concerns - Members may raise any specific trade concerns related to the implementation of the Agreement, but should advise any other Members concerned and the Secretariat in advance of the meeting of their desire to raise such concerns.
(c) Consideration of specific notifications received - Members may raise any questions or concerns with regard to specific notifications; however, they should advise any concerned Member(s) and the Secretariat of their intentions in advance of the meeting.
(3) The SPS Agreement and developing countries

(a) Implementation of the provisions for special and differential treatment - No further information on this issue has been provided by Members.
(4) Technical assistance and cooperation

At its last meeting, the Committee agreed to hold an informal meeting on technical assistance and cooperation if Members submitted papers on the subject.
Members are to submit, at least 30 days in advance of each regular meeting, examples of what they consider to be problems with significant trade impact which they believe are related to the use or non-use of relevant international standards, guidelines or recommendations.
(6) Matters of interest arising from the work of observer organizations

Observer organizations are invited to report on matters of interest arising from their work which are not covered under other items of the Committee's agenda.

INTRODUCTION

The effective implementation of the Agreement on Technical Barriers to Trade ("TBT Agreement") is a matter of great concern to Members, given the growing proliferation of regulations, standards and conformity assessment procedures. For this reason, prominence needs to be given to the difficulties that exist and the aspects which deserve particular attention in the work undertaken in the WTO Committee on Technical Barriers to Trade ("TBT Committee") need to be highlighted, identifying the factors which could enhance compliance with the relat

THE COMMITTEE ON TECHNICAL BARRIERS TO TRADE WILL HOLD ITS NEXT MEETING ON 20-22 MARCH 2012 STARTING AT 10 A.M.

MEMBERS ARE HEREBY REQUESTED TO PROVIDE THE SECRETARIAT WITH A LIST OF THOSE SPECIFIC TRADE CONCERNS THAT THEY INTEND TO RAISE UNDER AGENDA ITEM 2(B)(i) BY TUESDAY, 6 MARCH 2012. REQUESTS TO INCLUDE SPECIFIC TRADE CONCERNS ON THE AGENDA SHOULD BE ACCOMPANIED BY A REFERENCE TO THE SYMBOL OF THE RELEVANT NOTIFICATION, OR, IN CASES WHERE THE MEASURE HAS NOT BEEN NOTIFIED, THE REQUEST SHOULD PROVIDE A BRIEF DESCRIPTION OF THE MEASURE, INCLUDING RELEVANT REFERENCES. DELEGATIONS WISHING TO REPORT ON THE STATUS OF PREVIOUSLY RAISED CONCERNS, INCLUDING WITH RESPECT TO ANY RESOLUTION, ARE INVITED TO DO SO UNDER AGENDA ITEM 2(B)(ii).
