Pursuant to the Agreement Establishing the Trade Policy Review Mechanism (Annex 3 of the Marrakesh Agreement Establishing the World Trade Organization), the policy statement by the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu is attached.

The following communication has been received from the delegation of the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu on 14 August 2003 with the request that it be circulated to Members of the WTO.

With regard to the communications from the European Communities and its Member States, circulated to the Members of the Council for Trade in Services as documents S/C/N/231 and JOB(O3)/149 on 10 and 11 July this year respectively, I would like to take this opportunity to make, the following statement.
GATS/EL/7, GATS/EL/33 and GATS/EL/82) referred to in the communication S/C/N/231 by the consolidated list of Article II MFN exemptions attached to S/DCS/W/EEC.
The Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu notes that the consolidated list may constitute new exemptions which may require application of Article IX:3 of the Marrakesh Agreement Establishing the World Trade Organization, pursuant to paragraph 2 of the GATS Annex on Articles II Exemptions.
