The following informal note, dated 14 September, from the delegation of the European Communities is being circulated to the Members of the Committee on Specific Commitments.

Informal discussions in the CSC have shown that the W/120 classification and CPC correspondences for distribution services are incomplete and inaccurate (cf. pages 4 to 6 of 5 of the CSC Chairman Note of 5 April 2006 on possibilities for addressing selected classification issues).
In its annotated agenda for the meeting on 1 December 2006 (JOB(06)/256), the Chairman had invited Members to consider a modified correspondence, as set out in paragraphs 12-14 of the Annex to that annotated agenda. While Members agreed with the thrust of the modified correspondence, discussion in the CSC has shown that it was not still fully

Services salespersons – persons not based in the territory of Republic of Moldova and receiving no remuneration from a source located within Republic of Moldova, who are engaged in activities related to representing a services supplier for the purpose of negotiating for sale of the services of that supplier: (a) such sales are not directly made to the general public and (b) the salesperson is not engaged in supplying the service. Persons responsible for the setting up of a commercial presence: persons who are employees of an enterprise not having presence in Republic of Moldova and who have been beforehand employees of that enterprise outside Republic of Moldova for a time period not less than one year immediately preceding their application for admission, and who are entering Republic of Moldova for the purpose of setting up a commercial presence of that enterprise in Republic of Moldova. - Intra-corporate transferees – managers, executives and specialists, as defined below, who are employees of firms that provide services within Moldova through a branch, subsidiary, or affiliate established in Moldova and who have been prior employees of their firm outside Moldova for a period of not less than one year, immediately preceding the date of their application for admission:
managers – persons within an organization who primarily direct the organization, or a department or sub-division of the organization, supervise and control the work of other supervisory, professional or managerial employees, have the authority to hire and fire or remand the decision on hiring, firing, or other personal action (such as promotion or leave authorization), and exercise discretionary authority over day-to-day operations. These percentages do not apply in the following cases:
- If the foreign services supplier is the spouse, parent, child or sibling of a Peruvian citizen;
- In the case of personnel of foreign enterprises providing international land, air or water transport under a foreign flag and foreign registration;
- In the case of foreign personnel working in multinational service enterprises or multinational banks subject to the legal regulations applicable to these specific cases;
- In the case of foreign investors who hold a minimum of five Peruvian tax units (Unidades Impositivas Tributarias) throughout the term of their contract;
- In the case of artists, sportsmen or sportswomen or other suppliers of services taking part in public performances in Peru for a maximum of three months each year. Employers may request exemption from the percentages concerning the number of foreign workers and their proportion in relation to the enterprise's payroll for specialized professional or technical personnel in the following cases:

Scope
The following are definitions and principles on the regulatory framework for the basic telecommunications services. (a) under non-discriminatory terms, conditions (including technical standards and specifications) and rates and of a quality no less favourable than that provided for its own like services or for like services of non-affiliated service suppliers or for its subsidiaries or other affiliates;
(b) in a timely fashion, on terms, conditions (including technical standards and specifications) and cost-oriented rates that are transparent, reasonable, having regard to economic feasibility, and sufficiently unbundled so that the supplier need not pay for network components or facilities that it does not require for the service to be provided; and
(c) upon request, at points in addition to the network termination points offered to the majority of users, subject to charges that reflect the cost of construction of necessary additional facilities. 5 Interconnection: dispute settlement
A service supplier requesting interconnection with a major supplier will have recourse, either:
(a) at any time or
(b) after a reasonable period of time which has been made publicly known
to an independent domestic body, which may be a regulatory body as referred to in paragraph 5 below, to resolve disputes regarding appropriate terms, conditions and rates for interconnection within a reasonable period of time, to the extent that these have not been established previously. (c) the acquisition of the assets of the business where the total consideration paid or payable for the assets exceeds $NZ10 million;
(d) the issue or allotment of shares where the 25 per cent threshold has already been exceeded or will be exceeded as a result of the issue and where the total consideration paid or payable exceeds $NZ10 million. Executives and senior managers; as intra-
corporate transferees, for periods of initial

twelve months prior to their proposed

Services General conditions applicable to all
maritime service sectors: marketing and
sales of maritime transport services for
products covered under CPC 01, 02, 211,
213-216, 22, 2399 and 261; unbound. Specific commitments in this schedule are prepared in accordance with the Secretariat paper entitled "Scheduling of Initial Commitments on Trade in Services: Explanatory Note" (MTN. An “overseas person” is defined as an individual not normally resident in New Zealand; a company not incorporated in New Zealand; a New Zealand-incorporated company in which 25 per cent or more of any class of shares or 25 per cent or more of the voting power is held by overseas persons; or a nominee of the overseas person, whether or not the nominee is himself/herself an overseas person.
