Classification in the Telecom Sector under the WTO-GATS Framework
The following communication, dated 9 February 2005, from the delegation of the European Communities, is being circulated to the Members of the Council for Trade in Services and the Members of the Committee on Specific Commitments.

Summary:
This Communication addresses the legal uncertainty created by the existing classification used in the telecom sector under the GATS. Classification is first and foremost the basis to identify all services which Members wish to open to competition (market access) and for which they wish to ensure non-discrimination (national treatment). The following communication, dated 19 November 2004, from the delegation of Indonesia, is being circulated to the Members of the Committee on Specific Commitments.

This revised classification of Energy services reflects comments received in the multilateral and bilateral discussions held in the course of this year with interested WTO Members.
This paper is submitted without prejudice to Indonesia’s position on this and other service sector negotiations, or on any future offer on this or other sectors. Indonesia reserves the rights to modify this revised proposal at any time.
